Legal Advocacy For Unmarried Parents

In Texas, as in most states, when unmarried parents have a child, paternity will need to be established to create a legal relationship between the father and the child. Once paternity is determined, the child to be eligible for child support, and other benefits in including Social Security or veteran's survivor benefits and health insurance.

When paternity is established, the father's name can go on the child's birth certificate, and he will have rights and responsibilities to care for the child.

Parents can complete an Acknowledgement of Paternity (AOP) before the child is born, at the time of birth, or after the child is born. Once the AOP is filed with the birth registrar's office or at the Office of the Attorney General Child Support office, paternity is established.

If there is a question as to who the actual biological father is, or domestic violence would make it unsafe for both parents to sign the AOP, paternity can be established through the family court.
